ARBITRATION
(1) If a dispute arises out of or relates to these Terms and Conditions, or the breach thereof, and if said dispute cannot be settled through direct discussion, You agree to first endeavor to settle the dispute in an amicable manner by mediation in accordance to the Commercial Mediation Rules of the American Arbitration Association before resorting to arbitration. Thereafter, any unresolved controversy or claim arising out of or relating to these Terms and Conditions or a breach thereof shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the Arbitrator may be entered in any court having jurisdiction thereof.
(2) Any provisional remedy, which would be available from a court of law, shall be available to the parties to this Agreement from the Arbitrator pending arbitration.
(3) The situs of the arbitration shall be Fulton County, Georgia.
(4) In the event that a dispute results in arbitration, You agree that the prevailing party shall be entitled to reasonable attorney’s fees to be fixed by the arbitrator
SEVERABILITY
In the event any court of competent jurisdiction, arbitration tribunal, regulatory agency, or governmental agency shall declare invalid any provisions of these Terms and Conditions, such provisions shall be deemed to be rescinded or modified to the extent necessary to render them consistent or enforceable, as the case may be, with applicable laws, rules or regulations; and, such invalidity shall have no effect on the other provisions hereof, which shall remain valid and binding and in full force and effect.
MODIFICATION OF THESE TERMS AND CONDITIONS
FIC reserves the right to change the terms, conditions, and notices under which the FIC website is offered. You understand and agree that your use of FIC after the date on which the Terms and Conditions have changed shall be treated as acceptance of the updated Terms and Conditions.
SUCESSORS
This Agreement shall be binding upon the heirs, representatives, successors and assigns of the parties and shall inure to the benefit of the successors and assigns of FIC.
GOVERNING LAW
These Terms and Conditions shall be governed and construed in accordance to the laws of the State of Georgia.
